Terms of Use

Accessing this website, reading its material, or using a search feature means that the visitor accepts these terms. A person who does not accept them must stop using the website.

NO FCRA USE. No government office operates or endorses this private resource. Neither the website nor its advertising partners supplies consumer reports for housing, credit, insurance, employment, or another decision controlled by the Fair Credit Reporting Act (FCRA). The material points readers toward official Quay County, New Mexico record sources. It does not provide private investigative services and is not a consumer reporting agency.

1. What This Website Is

Government agencies do not own, manage, or sponsor this private reference website. It neither keeps official records nor conducts official searches. It also does not obtain records or file requests on a visitor's behalf.

The website identifies Quay County custodians such as the Sheriff's Office and New Mexico Judicial Branch courts. It also describes the New Mexico Department of Public Safety repository, access under the New Mexico Inspection of Public Records Act, subject review under NMSA 1978 §29-10-6, and the New Mexico Sex Offender Registry. Optional tools from outside providers may also appear.

2. Rules for Using This Site

By using the website, each visitor agrees not to:

  • Use bots, scraping software, or other automated means on these pages
  • Interfere with site performance or prevent another visitor from gaining access
  • Attempt to enter protected systems or obtain access without permission
  • Rely on site content for lending, insurance, housing, or employment decisions
  • Threaten, harass, or stalk a person by using information found here
  • Violate any applicable local, New Mexico, or federal law

3. No Harassment, Stalking, or Discrimination

Visitors must not turn information from this resource or a linked service into a means of intimidation, stalking, threats, harassment, or discrimination. The New Mexico Sex Offender Registration and Notification Act governs registry information, and unlawful misuse can lead to criminal consequences. Public safety is the registry's purpose. It does not authorize vigilantism or private punishment.

4. We Are Not a Consumer Reporting Agency

The website is not a consumer reporting agency for purposes of the FCRA. No credit report, consumer report, or background check is created here. Its advertising partners likewise do not offer a service intended to evaluate applicants for work or housing, set an insurance rate, or measure creditworthiness. Information obtained here or through a linked feature must not be used to:

  • Carry out any other activity regulated by the FCRA
  • Set an insurance premium or evaluate a person's credit
  • Approve or deny a license, permit, or public benefit
  • Evaluate an applicant for a lease or other housing
  • Make a decision to employ or dismiss a person

When the law requires a regulated consumer report, it must be obtained through an authorized government process or a suitable provider that complies with the FCRA. This website cannot serve that role.

5. No Legal Advice

Material concerning criminal records in Quay County is offered as general information, not as legal counsel. Advice about how a warrant, charge, conviction, or New Mexico expungement law affects an individual matter must come from a licensed New Mexico attorney.

6. No Warranties

All content and features are supplied "as is," without a promise that:

  • An outside search provider will return complete or correct results
  • Every page will be free from defects, mistakes, or security weaknesses
  • Website access will remain continuous and uninterrupted
  • Any item of information will always be current, complete, or accurate

A disposition, charge, sealing order, or expungement can alter what a record shows. Information may be missing, and nothing published here constitutes an official declaration by the Quay County Sheriff, a court, or any other public agency.

7. Third-Party Services and Links

A link may open an agency website, court system, legal source, or independent search service. Each destination controls its own content, access, fees, and handling of data. Visitors should read the destination's terms, since responsibility for an outside service remains with its operator.

8. Intellectual Property

Quay County Criminal History and its content partners retain rights in the website's code, logos, graphics, and written material. Prior written approval is required before that work may be copied, adapted, distributed, or used to make a derivative work.

9. Limits on Our Liability

As far as applicable law permits, no liability is accepted for damage resulting from the website, its content, its use, or any service reached through a link.

10. Indemnification

A visitor agrees to indemnify and hold the website harmless against claims, proceedings, costs, and reasonable attorney fees arising from that visitor's use or violation of these terms.

11. Governing Law

These terms are interpreted under New Mexico law. Any legal dispute related to use of the website must be filed in a court within New Mexico.

12. Changes to These Terms

Revisions may be made to these conditions. Updated language becomes effective once it is published here.

13. Cutting Off Access

Website access can be limited, suspended, or terminated without prior notice at any time.

14. Severability

If a court finds one term invalid or unenforceable, the other provisions remain effective. The affected provision will be modified no more than necessary to permit enforcement.

15. Questions

The Contact page provides the channel for questions concerning these terms.
